Yamaha aerox 11 months mot

Here I have Yamaha aerox runs mint electric and kick start only problem starts to choke on flat at 35 I have checked compression, clutch and rollers look all good I think the problem is someone has put the wrong exhaust on it looks derestricted at top but at the bottom it seems as a small gap but I don't know I am open up to all tidy swap
